Texas Women Blames Xarelto for Fatal Bleeding Incident

Adding to the worries of an already beleaguered group of pharmaceutical manufacturers, another lawsuit was added to the Xarelto Multidistrict litigation which is taking place in the Eastern District of Louisiana.

After a year of plaintiffs filing their lawsuits in different courts, the litigation against Bayer and Janssen pharmaceutical was centralized in the December of 2014. In almost all the cases, the plaintiffs alleged that they suffered internal bleeding and lethal strokes after taking the drug for some time.

As of now, more than 5800 cases have been consolidated in the federal court under the tutelage of Judge Eldon Fallon. The Justice was appointed in this case by the U.S. Judicial Panel on Multidistrict litigation.

After being appointed to oversee this case last year, Judge Fallon also specified the criteria for the selection of bellwether trial cases. According to that criteria, both the plaintiffs and defendants are free to present in front of the court 20 cases each of their liking. According to the complaint which is filed by the plaintiff, she started using Xarelto in April 2014 in order to reduce the risk of blood clotting. Much to her dismay, after using the medicine for just two months, she suffered from a life-threatening bleeding in June, the same year.

The plaintiff claims that her injuries resulted from using rivaroxaban. Moreover, she is also demanding more than $75,000 in damages from the manufacturers of the blood thinning medicine.

Since being approved by the FDA in July 2011, Xarelto has come forward as one of the best-selling blood thinning medicines in the current U.S. market. Originally introduced to replace the most traditional drugs – especially warfarin, the success enjoyed by the new blood thinner in the last four years is unprecedented, to say the least. However, while Xarelto sales granted billions to its manufacturers, the drug’s reputation has also suffered a hit in the last 4-years.

For example, at the start of this year, the number of cases against the medicine in the federal court was under 3000. However, within just 7 months of this year, the number of cases has exceeded 6000. Moreover, plaintiffs claim that this number will exceed 10,000 in the coming years.

On the other hand, the profits of Xarelto are showing no signs of slowing down. Since starting its journey with a $550 million sales volume in 2012, the blood thinning medicine has taken in billions in profits in the last few years.

In 2015 alone, the sales volume of the blood thinning medicine exceeded $2 billion in profits. Moreover, at the end of last year, the medicine was allowed access to the European and the Japanese market, increasing its overall volume.

Consequently, in the first quarter of 2016, the medicine has gained more than $500million in sales. Looking at its sales pattern, some experts have also concluded that the medicine will become the 19th most-selling drug by 2018.

Thus, where at one end the drug is generating billions in sales, the number of patients who claimed to have suffered from the medicine is also increasing by the day.
